Agent cops criticism for rent ordeal

A VICTORIAN Civil and Administrative Tribunal member scolded a real estate agent for failing to find alternative rental accommodation for a single Narre Warren mother and her two teenage children.

But despite the efforts of tribunal member Heather Barker, the Dawe family were forced to vacate their home on Friday and spent the weekend living in their car.

Ms Barker told real estate agent Vanessa Parkin at a residential tenancy tribunal hearing in Dandenong a fortnight ago that she could have been more "proactive" in helping the tenant after her client told her three months ago that her circumstances had changed and could no longer afford to pay rent.

Ms Barker said she would take the "unusual" order to postpone the eviction until last Friday.

"Since April she's told you she needed a cheaper place and if a cheaper place was found, the landlord wouldn't have lost any rent, nor the client got behind. In some cases you've got to be proactive to help everyone.

"Up until March she paid her rent on time until her circumstances changed - so why couldn't you say to other agents she had been a good tenant and paid her rent until her circumstances changed?

"I can't get through to you agents that you should discuss the situation."

After the hearing, tenant Debbie Dawe continued her desperate search for accommodation.

Ms Dawe said her plight began when she had an accident and broke her wrist and was unable to work for 16 weeks. At the same time her rent increased from $280 to $320 a week.

"I fell behind in my rent and it's been hard to catch up. The agent won't recommend me because I was in arrears.

"So I'm caught up in this without a good reference when it's so difficult to rent a property - as it is I'm a single mum and a low-income earner. That is all going against me.

"'It's been too competitive for the very few places I can afford. There is nothing to rent under $250 a week.

"I now am facing being turfed on

the street with my kids."

Ms Dawe said after a long search she found shared accommodation, a room for $300 a week.

"It's still expensive and unsuitable for the three of us. We are now preparing to sleep in the car. No wants to help me, because I'm not homeless yet."

Does she want to dramatise the situation anymore, it's not the property manager's responsibility to find her alternative accommodation. The property manager's job is to collect rent and look after the properties which the landlords have left in their care. If Debbie Dawe could not afford her rent, she should have given notice and found somewhere else to live or seeked help from the many agencies provided for assistance. If Debbie had broken her arm like she has stated she would have been given money from Centrelink or her employer while off work. It is unacceptable to not pay your rent. Debbie is just looking for sympathy and somebody other than herself to blame.

I'm sorry but this lady seems to be using her property manager as her scapegoat. I myself as a mother of eight and also on a low income make paying my rent my number one priority. Centrelink have advertised for a long time about them being able to get your bills paid through them for free. There is no other excuse but poor money management. Stop blaming Miss Parkin and seek a financial councellor.

I'm a Property Manager myself in the local area and I think I could speak for a lot of others in the industry that are sick of tenants that are crying poor that they can't pay their rent, but can afford to buy [unnecessary things] but can't pay their rent. A lot of these people don’t have their priorities in order, or they are just arrogant and believe the landlord will financially support them. Ifyou had a mortage you would be paying on average $100 per week more to live and the banks won't let you fall into arrears by 14 days - you can't even be one day late with your payments I would like the VCAT memebrs to come and spend a week in a Property Management department and see the other side of the real estate.

I too am also a property manager. The member of VCAT hears the stories and makes her decision from five minutes' discussion in the court room. She is not the one that has had to deal with constant phone calls from a landlord chasing their rent as their mortgage is now falling into arrears and they are having to pay interest charges or the promised payments from tenants on a constant basis. Five-to-ten minutes in the court room cannot justify this member's comments, maybe she should of delved into the information a bit further or even worked as a property manager herself for a week. As for the tenant, she needs to take responsibility for letting herself fall into this predicament. If she couldnt afford the property she should not have applied, if she suffered an accident she should off been receiving some form of Centrelink benefit or WorkCover and budgeted her finances better.

Nothing under $250 Ms Dawe states. I did an internet search of rentals and found plenty of houses to rent around Dandenong & Berwick. Perhaps Ms Dawe is being to fussy as where to live. Ms Dawe found emergency accomodation for her family that would cost $300 per week, or that equates to $100 each a week. Well that is a roof above the head and within her budget so the choice is hers to live in a car rather than a roof over her head. I think Ms Dawe is milking the public for sympathy.

Wow, what happened to having compassion and empathy for people? If it wasn't for us renters, you wouldn't have a job and I'm sorry but your responsibility is not only to the owner but to the people who rent the properties as well. I have lost count of how many property managers that I have dealt with, who are rude, arrogant and unhelpful. It is sad to hear that these property managers are so blantantly blunt....how about you try sleeping in a car and see how you like it?
